2. Subscription and payment

  • 2.1. Subscription Term:
  • The Base Membership is free and does not have a minimum term.
  • Core (Tier 2) and Icon (Tier 3) Memberships have a minimum contract term of 12 months.
  • 2.2. Free Trials:
  • A free 30-day trial may be offered on the Icon (Tier 3) Membership. Specific trial terms will be provided at the time of offer:
  • Understanding Your Icon Membership Trial and Insurance: The Icon Membership includes bike insurance provided by our partner, hepster™. During your 30-day free trial your right to withdraw from the Icon membership is extended to 30 days, including the insurance policy. Here’s what that means for you:
  • If you try the Icon Membership for 30 days, don't make an insurance claim, and decide not to continue:
  • You can simply cancel your Icon Membership before the trial ends.
  • The associated insurance contract will be withdrawn.
  • You won't have to pay for the membership.
  • If you try the Icon Membership for 30 days, don't make an insurance claim, and decide to continue:
  • Great! Your Icon Membership, including the insurance, will continue for the 12-month minimum period (so, for the next 11 months after your trial).
  • As a thank you for continuing with us, the first month of your paid membership is on us—we will cover the cost.
  • If you have an incident during your 30-day free trial and need to make an insurance claim:
  • You have two choices:
  • Option A: Continue with your Icon Membership & Make a Claim. You would agree to start your full 12-month Icon Membership. This means you’ll need to pay the membership fee for the first month (the trial month) and for the following 11 months. Once you do this, you can file your insurance claim and get the help or replacement your insurance covers.
  • Option B: Don't continue with Icon Membership & Cover the Costs Yourself. You can choose not to continue with the Icon Membership after the trial. If you choose this, the insurance contract is withdrawn, meaning you would be responsible for covering all the costs related to the incident yourself, as the insurance wouldn't apply.

2.3. Pricing and Payment:

  • Membership fees are as stated for each tier and region, payable monthly or annually in advance.
  • The price you pay for your ‘Icon’ (Tier 3) Membership is an all-in-one fee that includes the premium for the integrated bike insurance. This premium is set according to the tariff agreed between us and our insurance partner.
  • The specific payment methods accepted for your Membership subscription (Tier 2 – ‘Core’ and (Tier 3 – Icon) will be shown to you during the sign-up and payment process.

2.4. Automatic Renewal:

Unless cancelled in accordance with Section 5 (Cancellation and Termination), paid Memberships (Core and Icon) will automatically renew at the end of each subscription period (12-months) on a monthly rolling basis. The then-current membership fee will apply.

2.5. Late Payment or Non-Payment:

  • First Payment: If the first payment is not paid promptly but at a later time, membership will only begin from that date. If the membership fee is unpaid at the time of an insured event, the insurer is not obligated to provide any benefits, unless non-payment was not your fault. The insurer and Accell may withdraw from the contract as long as the premium remains unpaid.
  • Subsequent Payments: If a subsequent payment is not paid on time, you will receive a written request for payment at your expense, with a payment deadline of at least two weeks. If you remain in default after the payment deadline, no insurance coverage or membership services will be provided from that point until payment is made. The insurer and Accell may terminate the contract without notice if you remain in default after the deadline and were informed of this consequence in the payment request.

2.6. Price Changes:

We reserve the right to change the Membership fees from time to time. Any price changes will be communicated to you in advance, and, if applicable, how to accept those changes. For existing subscribers, price changes will take effect at the start of the next subscription period following the date of the price change. You will have the right to reject the price change by cancelling your Membership prior to the price change going into effect.

3. Insurance Terms (Applicable to Icon Membership Only)

The insurance component of the Icon Membership is provided by our partner, hepster. By subscribing to the Icon Membership, you also agree to be bound by the hepster Bike and E-Bike Insurance Terms and Conditions ("Hepster T&Cs"). A summary of key terms is below, but you must refer to the full Hepster T&Cs provided for complete details.

3.1. What Your Insurance Covers

  • Your Bike - The insurance covers the specific bicycle or e-bike that is listed on your insurance certificate. The bike must be one that does not legally require registration or mandatory insurance.
  • Essential Parts - Function-critical parts like the saddle, handlebars, lights and battery are covered.
  • Security Devices - The separate lock you use to secure your bike and any electronic anti-theft devices are also covered.
  • Accessories - Items like a bicycle basket are covered. However, compensation for these accessories is limited to a maximum of €100 per claim.

3.2. Deductible

In the event of a successful bike claim, a deductible of €100 applies. This is the out-of-pocket amount you are responsible for paying towards the claim.

3.3. Important Inclusions - What is not covered

  • Certain Accessories - After-market electronic accessories that you add yourself, such as navigation systems or action cameras, are not covered.
  • Tracker Issues - There is no coverage for any damage or loss that happens while:
  • The tracking device is in "passive mode".
  • The tracking device is not activated or its battery is below 20%.
  • The tracking device is not properly attached to your bike.
  • Cosmetic & Wear-and-Tear Damage - Scratches, dents, or other cosmetic issues that do not affect the bike's usability are not covered. Damage caused by rust or oxidation is also excluded.
  • When Other Insurance Applies - This insurance is considered "secondary". This means if the loss is covered by another policy you have (like household contents insurance), you must claim from that policy first.

3.4 Your Responsibilities as an Owner

To ensure your insurance is valid, you must meet the following conditions:

  • Lock Your Bike - When parked outside, you must secure your bike with a commercially available or integrated lock (such as the built-in anti-theft alarm). When parked indoors, it must be stored in a closed and locked room or area.
  • Keep Your Receipt - You must keep the original proof of purchase for your bike, which should show the manufacturer, brand, and frame number.

3.5. How to Make a Claim

  • Report it Quickly - You must report any incident to the insurer immediately, and no later than 14 days after you become aware of it. This should be done via the Accell app.
  • File a Police Report for Crimes - If your bike is stolen or damaged due to a criminal act, you are required to report it to the police within 24 hours of discovering the incident.
  • Provide Proof - You must provide a copy of the police report to the insurer within 14 days. You will also need to submit the original purchase receipts for your bike.

3.6. Selling or Transferring Your Bike

  • Insurance Can Transfer - If you sell or give your bike to someone else, the insurance policy can be transferred to the new owner.
  • Notify the Insurer - The new owner must acknowledge the insurance terms and you must both inform hepster's representative (MOINsure GmbH) of the change in ownership in writing.
  • Buyer's Right to Cancel - The new owner has the right to cancel the insurance contract within one month of acquiring the bike.

3.7. Where Your Insurance Works

Your insurance coverage is valid worldwide.

4. Cancellation and Termination

4.1. Cancellation by You

  • Base Membership: You can cease using the Base Membership at any time.
  • Core and Icon Memberships: These have a 12-month minimum contract. After the minimum term, you may cancel your recurring subscription according to the notice period specified at the time of subscription, typically before your next renewal date.

4.2. Termination by Us (Raleigh/Hepster):

  • We may terminate your Membership or the insurance component for breach of these Terms or the Hepster T&Cs.
  • In the case the Membership is for an indefinite period, you may terminate the subscription at the end of the next monthly term, with a notice period of at least one month. Termination must take place via the app.
  • In the case of an annual subscription, you may terminate the subscription up to one month before the end of the annual term. Termination must take place via the app.
  • Upon termination, you will have your membership until the end of the current subscription period. No refunds will be given for unused subscription periods.
  • We reserve the right to terminate or suspend your subscription in the event of non-payment or violation of the terms applicable to the subscription.

5. Right of Withdrawal

  • If you do not pay the first or one-time membership fee on time, we may withdraw from the contract as long as the membership fee remains unpaid, provided you were informed of this consequence and you cannot prove that the non-payment was not your fault.
  • Standard statutory withdrawal rights (cooling-off periods) may apply upon initial subscription as per applicable consumer protection laws in your region. Details will be provided at the time of subscription.

6. Amendments to these Terms

We reserve the right to amend these Terms and/or the terms of the insurance coverage at any time. We will provide you with reasonable notice of any significant changes. Your continued use of the Membership after such changes will constitute your acceptance of the new Terms. If you do not agree to the amended Terms, you have the right to cancel your Membership.

7. Governing Law and Jurisdiction

  • These Terms shall be governed by and construed in accordance with the laws of the country where the service is primarily provided to you.
  • For the insurance component (hepster), jurisdiction for lawsuits against the insurer is determined by their registered office, or the court at the location of your residence or habitual residence at the time the lawsuit is filed. For lawsuits against you, jurisdiction is determined by the court at your residence. The law of the country of origin applies to the hepster insurance contract.
